1. Privacy
- Your personal information is being collected,
and will be held by the Roads and Traffic Authority (RTA) of
Centennial Plaza, 260 Elizabeth Street, Surry Hills NSW to process
your application for Special Number Plates in accordance with the
NSW road transport legislation, including the Road Transport
(Vehicle Registration) Act 1997 and the Road Transport (Vehicle
Registration) Regulation 2007. You have rights to access and
correct the information under the Privacy and Personal Information
Protection Act 1998 (NSW) (PPIP Act). Failure to provide the
information, or any part of it, may result in your application not
proceeding. The information supplied may be disclosed by the RTA to
third parties including interstate driver licensing and vehicle
registration agencies, law enforcement agencies, providers of
compulsory third party (bodily injury) insurance, proposed
acquirers of vehicles and solicitors engaged in relation to motor
vehicle accidents and financial institutions for the purpose of
this transaction and to verify the information, for the purposes of
law enforcement, public revenue protection, public safety, NSW
compulsory third party insurance, enquiries relating to motor
vehicles, abandoned vehicles or purposes which would be relevant to
any acquisition of vehicles, throughout Australia or as otherwise
permitted under the PPIP Act.
- By submitting your personal information, you
warrant that it is true and complete. If you are applying for
Special Number Plates for someone else (the recipient), you also
warrant that the recipient has authorised the RTA's collection of
the recipient's personal information from you, or you have no
reason to believe the individual would object to his/her
information being supplied and that the information about the
recipient is accurate, up-to-date and complete.
2. Fees
2.1. Fees payable
- Fees for Special Number Plates are described
in these terms and conditions and as set out in the Special Number
Plates fee schedule. You may obtain a copy of the Special Number
Plates fee schedule from an RTA motor registry or online at
myRTA.com. The RTA may change the Special Number Plates fee
schedule from time to time without notice.
- All fees listed in the Special Number Plates
fee schedule are quoted in Australian dollars. Unless stated
otherwise, fees are inclusive of GST.
2.2. Refunds
- The RTA will refund the full order fee for
Special Number Plates paid by you where you cancel your order on
the same day the order fee was paid.
- The RTA will not refund any fees for Special
Number Plates paid by you including any order fees or any annual
fee in any other circumstances.
3. General terms
3.1. Reserving and ordering Special Number
Plates
- To reserve a Special Number Plate combination,
you must place an order for the combination and pay the applicable
order fee.
- Payments for orders placed through the RTA
Call Centre or myRTA.com can only be made using a credit card
accepted by the RTA.
- The RTA has absolute discretion to reject any
proposed Special Number Plate content including content submitted
for renewal of any Special Number Plate.
- The RTA may make a written request for the
Special Number Plates to be returned to the RTA if:
- The RTA makes an error in issuing the Special Number
Plate.
- The RTA, in its absolute discretion, deems the Special Number
Plate content to be unsuitable or offensive.
Failure to return the plate in accordance with the RTA's request
may constitute an offence.
- If the RTA requests the return of a Special
Number Plate, you may apply for the RTA to issue a new Special
Number Plate with altered style or content to the returned Special
Number Plate, upon payment of any applicable additional fees or
charges.
- The RTA may refuse an application under clause
3.1 (e) in its absolute discretion. If the RTA refuses an
application under clause 3.1 (e), the RTA will issue a Special
Number Plate with altered style or content to the returned Special
Number Plate.
3.2. Collecting Special Number Plates
- A notice will be sent to the address specified
on your order when the Special Number Plates are available for
collection from the RTA. Within 28 days from the date of the RTA's
notice you must pay all applicable fees and either:
- Collect the Special Number Plates.
- Request the RTA to place the Special Number Plates in
storage.
- If you do not pay the applicable fees to
either:
- Collect your Special Number Plates;
- Request the RTA to place the Special Number Plates in storage
within 28 days from the date of the RTA's notice;
the plates may either be destroyed or made available for purchase
by another customer. If you then wish to reapply for the same or
another Special Number Plate combination, you will have to place a
new order and pay applicable fees.
3.3. Rights to display only
- Special Number Plates always remain the
property of the RTA.
- Once the RTA has approved your application and
you have paid all applicable fees for the Special Number Plates,
you are granted a 'right to display' the Special Number Plates
issued to you. This means that you may either:
- Display the Special Number Plates only on a vehicle registered
in your name in NSW for which the plates are issued.
- Place the Special Number Plates in storage at an RTA motor
registry.
- The RTA may use any Special Number Plate
combination in promotional material, without notifying the holder
of the right to display the Special Number Plates.
- The right to display Special Number Plates
continues until three months after the expiry date of registration
for the vehicle for which the Special Number Plates are issued or,
where plates are in storage, 28 days after the expiry of the
storage period.
- You will lose the right to display Special
Number Plates if any of the following occur:
- You do not renew the registration of the
vehicle for which your Special Number Plates are issued within
three months of the expiry of the registration of the vehicle.
- You do not place the Special Number Plates in
storage at an RTA motor registry within 28 days of the expiry of
the storage period and pay the applicable Special Number Plate
lease fee and storage fee.
- You surrender your vehicle registration.
- Special Number Plates must be returned to the
RTA within 14 days of receiving a written notice from the RTA that
the right to display the Special Number Plates has been lost.
Failure to return the Special Number Plates within such timeframe
may constitute an offence. If you then wish to reserve the same
Special Number Plate combination, you will have to place a new
order and pay applicable fees.
- Notwithstanding anything in these terms and
conditions, the use of an unregistered vehicle on a road may
constitute an offence.
- Failure by the RTA to provide you with notice
of your vehicle registration renewal, or the expiry of any storage
period for your Special Number Plates, is not a breach of these
terms and conditions and does not affect the expiry of your right
to display your Special Number Plates, or your obligations under
these terms and conditions.
3.4. Sale of Special Number Plates
- Other than as set out in paragraph 3.4 (b)
below, you cannot sell or otherwise transfer the right to display
Standard Content and Personalised Content Special Number
Plates.
- You may apply to exchange the right to display
standard content or personalised content Special Number Plates with
another vehicle registered in your name or a member of your
immediate family. If the Special Number Plates are registered to a
company, the company may exchange the right to display with its
employee or its related body corporate. To exchange the right to
display standard content and personalised content Special Number
Plates, you and the person or company you intend to exchange plates
with must complete and submit to the RTA the applicable form and
pay the applicable exchange fee.
- You can sell or otherwise transfer the right
to display personalised plus content and numeral-only plates. To
sell your personalised plus content or numeral-only plates:
- You and the new holder of your plates must
complete and submit to the RTA the applicable form.
- The new holder must pay the applicable
fee.
- Upon the sale or transfer of your personalised
plus or numeral-only plates, you will be regarded as having
surrendered your number-plate. The RTA may issue you with another
set of number-plates with different content from that of the
transferred number-plate subject to the payment of the applicable
fee for that issue.
3.5. Placing Special Number Plates into storage
- When placing Special Number Plates in storage,
you will need to fill in the applicable form and pay the
appropriate storage and annual lease fee. You can have the Special
Number Plates moved to another registry on payment of applicable
fees.
- Your Special Number Plates can be kept in
storage indefinitely provided you pay any applicable fees in
advance.
- You can pay storage fees for up to five years
in advance. You can remove the plates at any time. You will be
entitled to a refund for annual storage fees you have paid in
advance. Refunds of storage fees are granted on the number of whole
years remaining and are not pro-rated.
- If your Special Number Plates are still in
storage and you do not renew the storage period within 28 days
after expiry of the storage period the Special Number Plates may be
destroyed or made available for purchase by another customer.
3.6. Damaged, destroyed or missing Special Number Plates
- If one or both of your Special Number Plates
are damaged you must, as soon as practicable:
- Notify the RTA in writing of the
damage.
- Surrender the Special Number Plate and unless
the RTA otherwise approves, any other matching/corresponding plate
with the same combination. Failure to do so may constitute an
offence.
- If one or both of your Special Number Plates
is lost, stolen or destroyed you must, as soon as
practicable:
- Notify the RTA in writing of the loss, theft
or destruction.
- Deliver any matching/corresponding Special
Number Plate to the RTA. Failure to do so may constitute an
offence.
3.7. Availability, remaking and replacement
- The RTA does not guarantee that any particular
style of Special Number Plate or content combination will be
available at any time.
- The RTA may cease production of a particular
style and/or design of Special Number Plate at any time without
notice.
- If your Special Number Plates are damaged,
subject to availability, you can apply for the plates to be remade
if you pay the applicable fee.
- If one Special Number Plate from a set is lost
or stolen, the remaining Special Number Plate must be surrendered
to the RTA. To apply for your Special Number Plates to be remade,
you must complete the applicable form and pay the applicable remake
fee.
- If one or both of your Special Number Plates
are lost, stolen or destroyed, you can apply for the plates to be
remade up to three months after expiry of the vehicle registration
period. Only the current holder of the right to display the Special
Number Plates can apply for the lost or stolen Special Number
Plates to be remade. If you request your lost or stolen Special
Number Plates to be remade with the same content, you must sign a
declaration on the applicable form acknowledging you may be stopped
and questioned by the police about displaying stolen plates. If
your application is not received within three months of the expiry
of the vehicle registration period, your application will be
considered to be a new order and you must pay all applicable
Special Number Plate fees, including any ordering fees.
- If you apply for Special Number Plates to be
remade, you must collect them in accordance with the process in
clause 3.2.
- If your plates have a manufacturing fault
reported within three years after the date of issue, subject to
clause 3.7 (a), the RTA will replace your Special Number
Plates.
3.8. Return and recall
You must return your Special Number Plates
to the RTA:
- as required by these terms and conditions,
or
if the RTA otherwise
notifies.
3.9. General
- Except as otherwise expressly stated in these
terms and conditions, the RTA is not liable for any loss or damage
of any kind however caused (including, but not limited to, by the
negligence of the RTA) which is suffered or incurred by you in
connection with these terms and conditions, the issue of Special
Number Plates, your use of myRTA.com (including the use of a credit
card or other debit device) or any linked website, the
non-availability of myPlates services for any reason, the rejection
or failure to receive your application for the issue of Special
Number Plates, or any act or omission of the RTA or the provision
of inaccurate, incomplete or incorrect information by you.
- To the extent that any legislation implies a
condition or warranty that cannot be excluded but can be limited,
clause 3.9 (a) does not apply to that liability and the RTA's
liability for any breach of that condition or warranty is limited
to the RTA doing any one or more of the following (at its
election):
- Replacing the goods or supplying equivalent
goods.
- Repairing the goods.
- Paying the cost of replacing the goods or of
acquiring equivalent goods.
- Paying the cost of having the goods
repaired.
- Nothing in these terms and conditions is
intended to exclude, restrict or modify any rights you may have
under any legislation which may not be excluded, restricted or
modified by agreement.
- You represent and warrant that you have full
power to enter into and perform your obligations under these terms
and conditions.
- You may not assign or otherwise transfer your
rights under these terms and conditions to any other person except
with the prior written approval of the RTA.
- In exercising your rights under these terms
and conditions, you must at all times, comply with all applicable
laws.
- Nothing in these terms and conditions is
intended to limit or qualify your rights or obligations under the
Road Transport (Vehicle Registration) Act 1997 or the Road
Transport (Vehicle Registration) Regulation 2007. Failure to comply
with your obligations under the Road Transport (Vehicle
Registration) Act 1997 or the Road Transport (Vehicle Registration)
Regulation 2007 may constitute an offence.
- If any section or part thereof of these terms
and conditions is found to be void, unenforceable or invalid, then
it is severed leaving the remainder in full force and effect,
provided that the severance has not altered the basic nature of
these terms and conditions.
- These terms and conditions are governed by the
laws of the State of New South Wales, Australia.
- The RTA may at any time vary these terms and
conditions by publishing the varied terms and conditions on
myRTA.com. You accept that by doing this, the RTA has provided you
with sufficient notice of the variation. The RTA is under no other
obligation to notify you of any variation to these terms and
conditions.
4. Definitions
4.1. Special Number Plates
Special Number Plates are subject to these
terms and conditions for issue of Special Number Plates and are
either number plates with:
- One to six
letters only.
- One to six numbers only.
- A combination of one or more letters with one
or more numbers, and not exceeding a total of six letters and/or
numbers, and:
- That is not routinely issued by the RTA.
- That the RTA has determined should be treated as a Special
Number Plate.
4.2. Personalised plates
Personalised plates are plates where the
content is selected from a combination of letters and numbers
within a certain range of combinations set by the RTA.
4.3. Standard content plates
Standard content plates are plates with the
content automatically generated by the RTA.
4.4. Personalised plus plates
Personalised plus plates are plates where the
content has a minimum of two letters or numbers and if one letter
only is used in the content it must not be the letter I or the
letter O.
4.5. Numeral-only plates
Numeral-only plates are plates where the
content comprises one to six numbers only.
4.6. Plate style
The style of a plate refers to the shape,
background colour and any graphics shown on the plate.
4.7. Plate content
The content of a plate refers to the
combination of letters and numbers that appear on a plate.
